OrderPaperToday – A court of Appeal sitting in Abuja has pronounced the Kogi East senatorial district vacant.
The seat was until the pronouncement occupied by Sen. Atai Aidoko of the Peoples’ Democratic Party (PDP).
Sen. Abdulrahman Abubakar of All Progressives Congress (APC) was initially declared winner of the March 28, 2015 election for the senatorial seat and was consequently inaugurated June 9, 2015.
However, the Independent National Electoral Commission withdrew the certificate of return on grounds that Abubakar was not qualified to participate in the election based on the orders of the election petition tribunal sitting in Lokoja.
INEC then conducted a re-run which Air Marshal Isaac Alfa of the PDP as winner.
However, an appeal court sitting in Abuja, on 14th of December 2016, sacked Senator Alfa and ordered that Sen. Atai Aidoko be sworn in.
Alfa had challenged the court’s ruling at the Supreme Court which on June 16 2017, dismissed the appeal and affirmed the election that declared Aidoko winner.
But the equation changed again December 14th 2016 when the Appeal Court ordered Aidoko to vacate the seat, pending the determination of the court of first instance.
Justice Abdul Aboki delivered the judgment on Monday, stating that the previous judgment was in error.
