OrderPaperToday – A Member of the House of Representatives and Leader of the South East Caucus of the All Progressives Congress(APC), Mr. Raphael Nnanna Igbokwe (Imo, APC) has applied to the Federal High Court Abuja to be joined in the suit challenging Femi Gbajabiamila to be Speaker of the 9th Assembly of the House of Representatives.
In his deposition before the court, Igbokwe stated that he is a Member of the House of Representatives who swore to an oath to defend the Law and the Constitution.
That as a Member of APC going against the party’s decision of choice of Lagos lawmaker, Mr. Femi Gbajabiamila would be tantamount to disrespect of party’s choice.
“The APC have indicated her choice for the Speakership of the 9th Assembly of the House of Representatives in the person of Rt Hon Femi Gbajabiamila. And anything contrary will be giving room for somebody from another party to take up the seat and this will affect him and his party as the APC led government will not be able to carry out its policies effectively”
He continue: ” the issue been canvassed by the plaintiff is a pre-election matter as provided in Section 35 of the electoral act.
The elections having been concluded , the matter can only be canvassed in the Election Petition Tribunal. That the Plantif is not a Member of APC nor an Aspirant and as such do not have Locus to institute the suit.
He further stated that the matter does not fall within the contemplation OF Section 66 of the Constitution as it was not a CRIMINAL Conviction but an admistrative professional disciplinary penalty.
Recall that The Federal High Court sitting in Abuja, was, on Wednesday, urged to bar Femi Gbajabiamila from contesting Speaker of the 9th House of Representatives. The plaintiff in the matter, Philip Undie said the the lawmaker was convicted for fraud to the of $25,000 in which he allegedly failed to disburse to his then client in 2003 in US, where he was practising as a lawyer.
